Terms of Service
The short version: BEFALL is interactive fiction played with AI characters. Coins only unlock access to episodes — endings and replays are always free. Don’t try to make the Service generate what it refuses to, and remember: the characters are fiction, not people, and not a substitute for care.
1. Agreement
These Terms are a contract between you and [LEGAL ENTITY NAME] (“BEFALL”, “we”, “us”), [REGISTERED MAILING ADDRESS]. They govern your use of the BEFALL app and website (the “Service”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Section 17 requires most disputes to be resolved by individual arbitration and waives your right to a jury trial and to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms. Please read it.
2. Eligibility: 16 and up
You must be at least 16 years old to use BEFALL. You confirm your age by providing your birth year, and you agree to provide it truthfully. Some content may be unsuitable for anyone under 16. We may suspend or terminate accounts we reasonably believe belong to someone under 16, and we delete the associated data. If you are under the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian who agrees to these Terms on your behalf.
The Service is offered in the United States. We do not currently offer it elsewhere, and you may not use location-masking tools to access it or to obtain pricing from another region.
3. What BEFALL is (and is not)
BEFALL is an interactive short-form story anthology: pre-authored episodic fiction organized into series, seasons, and episodes. You make choices and occasionally type short lines of your own, and AI software generates the characters’ replies within the authored story. Every character is an AI character: messages are generated by software, the characters are fictional, and no real person is on the other end. We disclose this everywhere.
BEFALL is not an open-ended AI companion. Characters do not message you on their own, conversations stay inside each episode’s story, and each episode ends. It is also not a medical, mental-health, therapeutic, or counseling service, and nothing in it is professional advice of any kind. If you are in crisis, call or text 988, or call 911 in an emergency.
AI-generated content is unpredictable. It can be inaccurate, inconsistent, out of character, or simply wrong, including about facts in the real world. Do not rely on it for anything that matters.
4. Your account
You can sign in with Google or with an email address and password. You can also play some of the Service before signing up; on the web, progress and coins from anonymous play may be stored locally on your device until you sign in, and clearing your browser storage will erase them. Keep your credentials confidential; you are responsible for activity under your account. Tell us at support@befall.today promptly if you believe someone else has accessed it. One account per person; do not share yours or use anyone else’s. We may send you service messages about your account, billing, safety, and changes to these Terms electronically, and you consent to receive them that way.
5. Acceptable use
You agree not to:
- Attempt to make the Service generate prohibited content, including any sexual content involving minors, sexually explicit material, content glorifying self-harm or violence, non-consensual acts portrayed positively, or content targeting real, identifiable people. The Service is designed to refuse; attempting to circumvent those refusals is a violation of these Terms.
- Probe, reverse engineer, scrape, or extract models, prompts, system instructions, story or character definitions, or other users’ data from the Service, or resell or sublicense access to it.
- Use bots, automation, or scripted clients against the Service, or interfere with its operation, rate limits, moderation, or safety systems.
- Use the Service to harass, defraud, or harm anyone, to infringe anyone’s rights, to distribute malware or spam, or to violate any law.
- Abuse coins, promotions, referrals, or free grants, including creating multiple accounts to claim them, or attempt to buy, sell, or transfer coins outside the Service.
Every line you type passes through automated moderation before the AI sees it, and what the AI generates is screened too. We may deflect or refuse content, log moderation events, and, for repeated or serious violations, suspend or terminate your account. We are not obligated to monitor content, but we may review it where necessary to operate the Service, enforce these Terms, or comply with law.
6. Your content and ours
You own the lines you type. You grant us a non-exclusive, worldwide, royalty-free license to host, store, and process them solely to operate the Service for you: generating the characters’ replies, maintaining your story state, moderation, safety, support, and backups. This license ends when you delete your account, except for copies we must keep for the limited legal and security reasons described in the Privacy Policy.
We do not claim ownership of what you type, we do not use it to train AI models, and we do not sell it. Our contracts with AI model providers prohibit them from training on your data. We take no broader commercial license over your content than the operational one described above.
What we own. The Service itself — the series, seasons, and episodes, the characters and their writing, the artwork, the software, and the BEFALL name and marks — belongs to us or our licensors. You may keep and share the endings you earn and the replies you receive for your own personal, non-commercial use; everything else requires our written permission. Story content, character likenesses, and artwork are not licensed for redistribution, resale, or training other models.
7. Coins
- What they are. Coins are the Service’s virtual currency. They do exactly one thing: unlock access to episodes. The first episode of every series is free. Current coin prices, pack sizes, and unlock costs are shown in the app and may change.
- We never sell outcomes. Once an episode is unlocked, everything inside it is free: every choice, every ending, every replay. Endings and replays are free forever — we will never charge coins or money for a story outcome.
- Where to buy. Coin packs will be sold through your app store’s in-app purchase system and, later, through web checkout. Web purchases are not yet open. Purchases made through an app store are also governed by that store’s terms.
- Free coins. We may grant promotional coins — for example at sign-up, through referrals, through optional rewarded ads in the app, or as community rewards. Promotional coins are never redeemable for cash, and we may withhold or reverse them for self-referral, duplicate or automated accounts, or other abuse.
- License, not property. Coins are a limited, personal, non-transferable license to use a feature of the Service. They are not money, not a stored-value or gift-card product, and have no cash value. You cannot sell, trade, transfer, or redeem them for cash, and they are not your property or an account balance you own.
- Purchases are final. Coin purchases are consumed on use and are non-refundable except where required by law or by your app store’s refund policy.
- Expiry and forfeiture. We do not currently expire coins. If we ever introduce expiry we will give at least 30 days’ notice first. Unused balances are forfeited if you delete your account or if we terminate it for a violation of these Terms.
- Changes. We may change unlock costs, grants, and pack contents prospectively. We will not retroactively reduce a balance you already hold except for fraud, abuse, or an error in our favor that we correct.
8. Subscriptions, if and when offered
We do not currently sell a subscription. If we offer one in the future (for example, a plan that unlocks all episodes), these rules will apply:
- Auto-renewal. Subscriptions would be billed through your app store or web checkout and renew automatically at the then-current price at the end of each billing period until you cancel. Whichever channel you buy through governs the mechanics of billing, cancellation, and refunds for that purchase.
- Cancelling. Cancel anytime in the app or in your app store’s subscription settings. Cancellation takes effect at the end of the current billing period and you keep the benefits until then.
- Price changes. We may change prices prospectively with at least 30 days’ notice; changes apply from your next renewal, and you can cancel before then.
- The promise holds. A subscription would only ever change how episode access is paid for. Endings and replays inside episodes you can access stay free.
9. Third-party services
The Service relies on third parties — app stores, purchase infrastructure, cloud hosting, AI model providers — and may link to sites we do not control. Purchases you make through an app store are also governed by that store’s terms. We are not responsible for third-party services, and linking to one is not an endorsement.
10. Copyright complaints (DMCA)
If you believe content on the Service infringes your copyright, send a notice to our designated agent, [DMCA DESIGNATED AGENT], at support@befall.today or [REGISTERED MAILING ADDRESS]. Include: your signature (physical or electronic); identification of the work; identification of the material and where it is on the Service; your contact details; a statement that you have a good-faith belief the use is unauthorized; and a statement, under penalty of perjury, that the notice is accurate and you are authorized to act. You may submit a counter-notice under 17 U.S.C. §512(g) if material of yours was removed in error. We terminate the accounts of repeat infringers.
11. Suspension and termination
You can stop using BEFALL at any time and delete your account as described in the Privacy Policy, which permanently deletes your data and forfeits unused coins. We may suspend or terminate your access for violations of these Terms, to comply with law, to protect users or the Service, or if we discontinue the Service — with reasonable notice where practicable, and immediately where a violation is serious or a delay would cause harm. If we terminate the whole Service, we will give notice and, where you have paid in advance for something you will not receive, a pro-rata refund. Sections that by their nature survive termination survive.
12. Disclaimers
The Service is provided “as is” and “as available”. BEFALL is designed for entertainment and is not a substitute for human relationships, professional support, or emergency services. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, secure, or error-free. Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our total liability for all claims will not exceed the greater of $100 or the amount you paid us in the twelve months before the claim arose. These limits apply even if a remedy fails of its essential purpose. Some states do not allow these limitations; where they do not, they apply to the fullest extent permitted, and nothing here limits liability that cannot lawfully be limited.
14. Indemnity
You will indemnify and hold harmless [LEGAL ENTITY NAME] and its officers, employees, and agents from claims, damages, and reasonable legal fees arising out of your use of the Service, your content, or your breach of these Terms or of any law or third-party right. We may assume the defense of any such claim at our expense, and you will cooperate with us.
15. Time limit on claims
Any claim arising out of these Terms or the Service must be filed within one year after it arises, or it is permanently barred, unless applicable law prohibits shortening the period.
16. Governing law
These Terms are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts in [COUNTY], [STATE]. Nothing here deprives you of the protection of mandatory consumer-protection rules of the state where you live.
17. Dispute resolution and arbitration
Read this section carefully — it affects your legal rights.
Talk to us first
Most problems are faster to fix by email. Before starting arbitration, send a written notice of dispute to support@befall.today describing the problem and the relief you want. If we cannot resolve it within 60 days, either of us may start arbitration.
Binding individual arbitration
Except as stated below, you and we agree that any dispute arising out of these Terms or the Service will be resolved by binding individual arbitration, not in court and not before a jury. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules and its Consumer Arbitration Minimum Standards where applicable, before one arbitrator, in [COUNTY], [STATE] or, at your election, remotely or in the county where you live. The Federal Arbitration Act governs this section. The arbitrator decides all issues except that a court decides the enforceability of the class waiver below. We will pay filing and arbitration fees to the extent the applicable consumer rules require.
Class action waiver
You and we each waive the right to bring or participate in a class, collective, consolidated, or representative action. The arbitrator may award relief only to the individual party seeking it. If this waiver is found unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies to the remaining claims.
What is not covered
Either of us may bring an individual claim in small-claims court, and either of us may seek injunctive relief in court for infringement or misuse of intellectual property. Nothing in this section prevents you from reporting a concern to a government agency.
Your 30-day opt-out
You can opt out of arbitration and the class waiver by emailing support@befall.today with the subject “Arbitration Opt-Out” within 30 days of first accepting these Terms. Include your account email. Opting out does not affect anything else in these Terms, and we will not treat it as a reason to close your account.
18. Changes to these Terms
We may update these Terms. We will post the updated version here and, for material changes, notify you in the app or by email at least 14 days before they take effect — except where a change must take effect sooner for legal or security reasons, or applies only to a new feature. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the Service and delete your account. Material changes do not apply retroactively to a dispute already in progress.
19. General
These Terms and the Privacy Policy are the entire agreement between us about the Service. If a provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, and we will tell you if that happens.
